​1. SERVICES

Photographer agrees to provide photography services as outlined in the selected package, invoice, or booking confirmation. Services include studio, outdoor, and on-location photoshoots only.

2. RETAINER & PAYMENT

• A non-refundable retainer of 50% is required to secure the session date and time.

• The remaining balance is due on or before the session date.

• All sales are final. No refunds will be issued.

• Photographer reserves the right to withhold services or image delivery until full payment is received.

3. RESCHEDULING & CANCELLATION

• One (1) courtesy reschedule is permitted with 24–48 hours’ notice, subject to availability.

• The retainer may be transferred one time only.

• Any additional reschedule requests require a new retainer or rescheduling fee, at Photographer’s discretion.

• Requests made within 24 hours of the scheduled session may result in forfeiture of the retainer.

• Same-day cancellations and no-shows are considered completed sessions and are not eligible for refund or reschedule.

4. CLIENT PUNCTUALITY

• Session time begins at the scheduled start time.

• Late arrivals result in reduced session time.

• Clients arriving 30 minutes or more late may have their session canceled with no refund.

5. NO-SHOW POLICY

Failure to appear without notice constitutes a completed session with no refund or reschedule.

6. CREATIVE CONTROL

Client acknowledges familiarity with Photographer’s portfolio and editing style and grants Photographer full creative control over:

• Composition

• Posing

• Lighting

• Image selection

• Final edits

Photographer’s artistic judgment is final.

7. SETUP, BACKDROPS & PROPS

• Client will finalize all setup details (including backdrops, color schemes, props, and vision) during consultation.

• Once confirmed, the setup is considered final.

• Any changes requested after confirmation may result in additional fees at Photographer’s discretion.

• Changes requested within 72 hours of the session are not guaranteed and may be denied.

• Purchased or custom items cannot be changed, exchanged, or refunded.

8. EDITING & IMAGE SCOPE

• Packages include standard professional editing only (color correction, exposure adjustment, minor retouching).

• Advanced editing is not included and may incur additional fees at Photographer’s discretion.

Advanced editing includes, but is not limited to:

• Compositing or merging multiple images

• Adding or removing people or objects

• Background replacements

• Extensive retouching or body modification

• Vision expansion based on reference images or concepts

Photographer reserves the right to decline requests outside the original booking scope.

9. IMAGE SELECTION & TURNAROUND

• Turnaround time begins after Client submits image selections.

• Standard delivery is 7–10 business days, unless otherwise stated.

• Photographer is not responsible for delays caused by late or incomplete selections.

10. IMAGE DELIVERY & STORAGE

• Final images are delivered electronically.

• Client is responsible for downloading, saving, and backing up images.

• Photographer is not responsible for lost or deleted files after delivery.

11. COPYRIGHT & IMAGE USAGE

• Photographer retains full copyright ownership of all images.

• Client receives a personal-use license only.

• Images may not be altered, sold, or used commercially without written permission.

• Photographer may use images for portfolio, marketing, website, and social media unless Client submits a written opt-out prior to the session.

12. DISSATISFACTION & DISPUTES

• If Client is dissatisfied, Client agrees not to publish, distribute, or alter images.

• Concerns must be communicated directly to Photographer for resolution.

• Client agrees not to initiate chargebacks and acknowledges this Agreement as proof of services rendered.

13. CLIENT RESPONSIBILITY & BEHAVIOR

• Client is responsible for their own conduct and that of any guests or children.

• Photographer may end the session early due to unsafe, disruptive, or uncooperative behavior, with no refund.

14. APPEARANCE & COLOR DISCLAIMER

• Photographer is not responsible for hair, makeup, wardrobe, or styling choices.

• Color variations may occur due to screen or print differences and are not Photographer’s responsibility.

15. LIMITATION OF LIABILITY

Photographer is not liable for injuries, accidents, or lost personal items. Liability is limited to the return of payments received, excluding the retainer.

16. FORCE MAJEURE

Photographer is not liable for failure to perform due to circumstances beyond control, including illness, weather, power outages, or equipment failure.

17. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Texas.

18. AGREEMENT ACKNOWLEDGMENT

By booking services and submitting payment, Client acknowledges they have read, understood, and agreed to this Photography Service Agreement.
